1. Our Responsibility
GUANI S.A declares that acts only as intermediary agent between the passengers and the hotels or businesses that provide services that itself is not carried out with its own transportation being freed thus of every responsibility. Reason by which, GUANI S.A cannot guarantee the accuracy of the hotels, resorts or any another supplier that have not been published but that can be offered the client as an additional service. Itself does not it hold responsible of damages, illness, loss, additional expenses, accidental delays or other irregularity that can be caused for acts or omissions of negligence or intentional on the part of companies providers, related to the transportation, accommodation or other services linked to the execution of the tourist program; or by natural disasters, social problems or acts of God. We reserve the right to reject, to accept or to retain any person as a member of any of our trips. The luggage is responsibility of the passenger during the whole trip. If a member of the group gets sick or is found disabled, we will take care of him through a doctor qualified, the expenses should be assumed for the client, including hospitalization and necessary medicines of being. In case of accident and/or evacuation of emergency, all the expenses will be covers by the client.
2. RESERVE POLICY
To carry out a reserve is necessary that you be of legal age. You guarantees us to be financially responsible for the payment of the services hired to our bias. You initiate its order of reserve by means of the application form of reserve that is received for e-mail, by telephone or web.
Our commitment is to respond to your consultation and contact you within the 48/72 hours to offer you with information on the matter and to communicate you wiht the availability and rates. The reservations will be performed in partial form to the reception of the deposit of the client. The reservations only are confirmed by means of the payment of the advancement stipulated and/or in the toatal amount as it can be the case. All the rates and current conditions can vary without subject to notice and they are you hold to availability.
Types of Reserve:
Individual. -individual reservation to a number is called less than or equal to 10 passengers. Groups.- group to a greater number is defined that 12 passengers. A reserve is accepted and returns final since the moment that GUANI S.A have confirmed the registration. From this moment that the contract takes effect among GUANI S.A and the client. The contract is among GUANI S.A the client, having been all the people mentioned in the reserve. The person that hires the services of GUANI S.A, guarantees in this way that or he/she has representation authority total of all the people whose names they appear and confirms in this manner that all the people mentioned are in full knowledge of the circumstances and they accept the same.
3. FORM OF PAYMENT
The total payment can be performed by means of credit cards, paypal, banking transfer or in cash in American dollars in our offices. In some cases certain users require the total payment in cash and in most cases the promotions are valid only for payments in cash in our offices. It notes: The expenses of transfer will be assumed by the passengers and/ or tour operator.
4. CHANGES MADE BY THE CLIENT
Any change to the original reserve, should be confirmed by the person that initially acquired the services. Any cost or charge in which GUANI S.A or our suppliers we incur due to the change will be loaded to the Client. In spite of the fact that we will do all the reasonable efforts to accommodate the changes and additional requests, its availability cannot be guaranteed.
5. CLIENT SUSTITUTION
If some of the members of the group is seen prevented to travel, its reserve can be transferred another person that if can do it, whenever this change be notified, at least 20 days before the date of departure after this date an administrative charge will be reloaded along with any additional cost that our suppliers decide to charge. The airlines can charge to the 100% of the cost of a new one ticket.
6. CANCELATION POLICY
The Client can cancel its reserve at any moment whenever the cancellation is communicated to GUANI S.A in writing. If the cancellation themselves effectives from the 30 prior days on the way out, the refund will be subject to the discounts that perform the borrowers of the services according to the local regulations of each country and to the expenses in which had incurred, since some of these services (hotel trade, transportation, agencies etc.) are subject to special economic conditions of contracting and therefore to special expenses In case of annulment. We recommend consulting the private conditions of each program. The passenger that itself not on time predicted present will not have the right to reimbursement. 7. CHANGES AND CANCELATIONS MADE BY GUANI S.A
You mention GUANI S.A does its better effort by operating all the tours according to it published, upon accepting this contract, the Client accepts the possible need or recommendation of varying or to modify an itinerary or its content due to prevailing local conditions. GUANI S.A has the right to cancel is reserved or to vary any of the facilities, services or prices (including flights, lodgings or any another service) and to substitute the same with alternative services of comparable monetary value without any clearing, without accepting the enjoyment loss possibility as a consequence of these changes. GUANI S.A will be affected with no charge in case changes be given – out of their control – in the hour of departure or date of a tour, flight or another form of transportation.
8. OVER PRICE
GUANI S.A has the right to increase the cost of the reserved and tour taking into account the following concepts: governmental disposition, currency, costs of transportation including the cost of fuel, charges of over flight, charges of airport and increment in airfares planned
9. PASSPORT, VISA AND VACCINES
It is the client responsibility to possess a valid passport, visa, vaccines and medicines that can require during the duration of the tour. Information on these themes and other related they are delivered in good faith but without any responsibility on the part of GUANI S.A.
10. AGE, PHYSICAL CONDITIONS, PARTICIPATION
It is expected that all the clients has a good physical conditions to comply with the itinerary of the tour of their election. Under age (less than 18 years), accompanied by some of legal age, they can be accepted in the tours they operated by GUANI S.A whenever be tested that their companion accepts total responsibility by them. GUANI S.A has the right to cancel a reserve. The Clients accept the authority and decisions of the employees of GUANI S.A, tour leader and agents; during the tour with GUANI S.A if an opinion of this person, the health or conduct of a client, before or after the start of the tour, endangers the security, comfort or happy progress of a tour, the client will be able to be excluded of the totality or part of the tour.
11. PRICES
CHILDREN PRICES. Children are considered from 3 to 10 years old, the same that will always paid for the terrestrial services. The hotel services depend on each hotel. The children less than 3 years in a general way to share room without charge with their parents and thus same will not pay terrestrial services.
12. TICKETS AND MEALS
All the entrances to museums, air tickets and spectacles, besides the national parks and the diet they are included only when is detailed in the program. Our services do not include alcoholic and non-alcoholic beverages.
13. THE LUGGAGE
A suitcase is permitted only and a bag of hand by each person aboard our units of transportation, any additional luggage will be able be charged as extra by its transportation directly to the passengers.
14. TOUR GUIDE SERVICES
All our services and excursions will be accompanied by Spanish, English guides - . In case of guides of another language, should be requested in the reserve.
15. LOCAL LAWS
All the participants in tours operated by GUANI S.A should respect and obey the laws and regulations of the countries visited otherwise, GUANI S.A will not be able to comply with the obligations specified in this contract.
16. ILLNESS OR INCAPACITY
Every person that suffer from some illness or incapacity or this under some type of processing by any physical or medical condition, should declare the nature of that condition to the moment to be registered, in order to be able to coordinate the availability of any medicación or processing that can be required during the tour. The not to carry out this explanation will constitute a breach of the present contract and will result in the exclusion of that person of the tour without reimbursement of the funds that may have been able to have paid. If the tour chosen includes any excursion or transfer in rowboat, of any type, the Client should leave established to the moment of the reserve if he or she does not know to swim. This it will not avoid that the Client participate in the tour, but he will permit that GUANI S.A take the precautions of the case to assure the security of the client in the appropriate moments.
17. IF THE CLIENT HAS A COMPLAINT
If the client has some complaint on some of the services of the tour, he/she should let the tour leader or another representative of GUANI S.A at the moment, so that they can do their better effort to rectify the situation. Alone when GUANI S.A have knowledge of any problem that itself present, will be possible to correct this. In case that the client does not report the problem immediate, the possibility of a clearing on the part of GUANI S.A, is reduced. If a problem, in fact has been reported immediately, remains without been resolved, the complaint should be performed in writing inside the 28 following days after to have completed the trip.
18. FLIGHT RESERVE
GUANI S.A will do the best by assuring that all the prices of the flights are correct at the moment of quoting a trip. The airlines are reserved the right to change or to increase their rates without subject to notice. Once a deposit by an airfare is carried out, is guaranteed that a reserve is expecting for you, does not guarantee the rate. The alone rate is guaranteed when have itself done a payment full and the ticket have been emitted. The reserves of flights cannot be transferred. The flying time given by GUANI S.A is for a general guide and they are you holding to changes. The hours brought up to date will be shown in the tickets. The client should check the tickets very carefully. GUANI S.A compromises to inform the client as soon as possible in case itself any present alteration of the trip. The details of the airlines also are you hold to change. These alterations do not constitute a significant change for the holidays and therefore they will not be motive of cancellation without paying the charges previously detailed. GUANI S.A will not be responsible for some delay in its flight, if this delay is caused for an adverse climate; the traffic controllers action, authorities of the airport or local governments; change of schedules on the part of the airline; mechanical failures; strike; industrial actions or some another reason.
19. TRAVEL INSURANCE
We recommend firmly that, at the moment to carry out the reserve, hire for itself or for their client a valid insurance in their country to cover costs of cancellation, claims by luggage, medical expenses, accidents and other eventualities The clients should be assured that there they be not clauses of exclusion that limit the protection by the type of activities in their tour. The clients should be felt satisfied that any insurance acquired be what need and they should acquire additional insurances, to be necessary.
